Had I felt a 50/50-split was in the best interest of mine and my children’s future, I would have foregone the attorney retainer and mediation fees, rolled-up into the fetal position and allowed my spouse to gut the family on the way to the next episode of debauchery. When I asked Xavier why individuals bother to hire representation if the outcome is always 50/50, his response was that otherwise, the opposing attorney would “eat my lunch”. From my perspective, Xavier did little more than set the table and encourage my spouse and attorney to sit down and partake. As the saying goes, I can do poorly all on my own. Had I not held my ground and structured my own deal, which allowed my spouse to avoid the cost and embarrassment of past transgressions being aired before a court, the outcome would have been markedly different and financially disastrous for the kids and me. My advice, if faced with a contentious divorce and finances, hire an experienced pit-bull, not a meek, indifferent, paper-pusher. The cost may be the same, but the results could be night-and-day different. I believe Xavier may have a future in family law, but he’ll first need to learn true client advocacy and how to lace-up the gloves and throw punches.
