Thomas F. (“Tom”) Martello, Jr. has practiced law in Ohio since 1992. He is a graduate of Yale University (B.A. 1987, English, Distinction in Major), and of Capital University Law School (J.D. 1990, Cum Laude, Law Review Articles Editor). Tom is an experienced litigator in a wide variety of areas. He has successfully tried many criminal and civil cases, and he has been successful in the court of appeals. As an Assistant Attorney General for the State of Ohio, he prosecuted death penalty habeas corpus appeals in United States District Court, and argued cases before the United States Court of Appeals for the Sixth Circuit. In private practice, in addition to his personal injury and criminal experience, he has participated in major asbestos litigation, both at the trial and appellate court levels.

I had been pulled over late one night and was charged with a DUI. I looked into lawyers and was given Tom's information by a friend who he had represented. Upon meeting with him, I felt comfortable to hire him as my lawyer. He walked me through each and every court proceeding as well as the possible outcomes. I was very nervous as this was my 3rd DUI in 12 yrs to where I was being charged for city DUI laws rather than state DUI laws; so I was facing serious jail time as well as a longer drivers licesnse suspension. Tom worked very hard on my case to get me the very best possible outcome for the poor choices I had made the night I got pulled over. He not only gives the sense that he is there to represent you as an attorney but is there as a friend as well. There aren't many lawyers like that who care to relate to you on a personable level. I would recommend Tom to anyone who would ask me if I knew any good attorneys. I was more than pleased with the outcome Tom got on my behalf. I was able to serve my very minimal time I was sentenced for being a 3rd DUI, while I was able to leave and go to work to maintain income to pay bills, rent and was placed on 18 months probation. Tom knew I was willing to face my consequences for my actions but he also seen that I was not an alcoholic who had a major drinking problem to where I didn't need to have my life turned upside down because of my choice that night. So he fought hard to get the outcome we received and I accepted it willingly as I knew it could have been much worse without a lawyer such as Tom. Thank you Tom for the help you provide to those in the community.

The first time I met Tom Martello was for a domestic violence case. He completely handled everything flawlessly and even offered his cell phone in case I ever felt in danger. He did actually come pick me up and bring me to a safe place. My ex was charging me with domestic violence and Tom figured it out immediately what the real situation was. The first thing I noticed was how very concerned and truly empathetic he is compared to other attorneys. I have also had the good fortune to be represented by Tom in 2 personal injury lawsuits. Yes, it's not lucky to have 2 accidents severe enough to have lawsuits, but in fact I was injured from a ride at King's Island, which has since been removed as well, prior to knowing Tom. I wish he had represented me for the King's Island case because I know he would have gotten me a far more equitable settlement. I really appreciated that Tom was always prompt in responding to phone calls and took the time to answer all of my questions and explain my options clearly and logically. Again, very unlike other attorneys that I would almost have to argue with their assistants to get a phone call back. He was able to settle both cases without having to go to court and I was very satisfied with the outcomes. I have also retained Tom for his knowledge and assistance in other legal matters. Tom is truly an outstanding attorney. I have highly recommended him to many friends and family.

Mr. Martello is just an outstanding attorney: Tom handled a very difficult problem for me, at a difficult time in my life. I came to him with a very challenging situation; after receiving poor representation from a prior attorney (and not being knowledgeable with the legal system), I had already pleaded guilty to charges against me. Tom was not only able to help me better understand the scope of my situation and possible resolutions but is so experienced and knowledgeable that he was able to navigate a better outcome for my current situation and have a prior minor misdemeanor conviction completely thrown out. This allowed me to have my record sealed and expunged later, which was imperative for my career (and life!). Tom was professional, informative, clear, and precise. If believe you have no alternatives or think your situation is hopeless, consult with Tom, as you may have options you were not aware of or think possible.

Tom represented my brother in a high profile criminal case. My brother had schizophrenia and the case was emotional on both sides. There wasn't any judgement given or portrayed from Tom. Tom sat with my brother and listened to him even when it was difficult to follow. While this case was long, his investment in this case never waivered. Tom took our case when other lawyers would have been intimidated. He is down to earth, compassionate, honest, and is an expert within the courtroom. It was a long uphill battle but Tom forged ahead, never giving up the fight. There are no words that adequately convey the gratitude I feel. As a result of Toms expertise, my brother received the help he would have never received being in jail. My brother suddenly passed just 2 years after his trial and Toms dedication to my brother and our family allowed us to enjoy what time he had left. We highly recommend him to anyone in need of a dedicated attorney who treats you like family.

I came to Mr. Martello to get a restraining order against me dropped that was only filed because I missed the court date. This was important to me because the person who filed it against me is still using pictures of me in my military uniform for his business and keeps sending my young son letters. Once at his office he pulled me up online and saw I had a marijuana charge and only wanted to focus on that even though i had 3 months before we could file to get it off my record. On my restraining order he told me he would talk to the judge, get a page I was missing and make sure he can contact the other party then either call or send a letter in two weeks. At his office we only talked about my case for about 15 minutes and he talked to my friend who was with me about wrestling for 30 minutes. A little over a month goes by I call him on Friday and he says he is out of the office today but his wife works for the courts so its gonna be easy to get the paper im missing and talk to the judge and get back to me next week. Another two weeks goes by so I call him again on a Friday and he says he's again at home but this time he makes an appointment with me on Tuesday even though he still has not gotten the page I needed or talk to the judge and wanted me to pay him 300 dollars. Over the weekend I realized it was not smart but stupid to go with him on the restraining order, that I should only go with him for the marijuana charge since he has done nothing for it in almost two months like he said he would! Once I contacted to tell him he got upset and told me he wanted to drop my marijuana case even though I already gave him money to represent me! I wasted 2 months, money and my own time dealing with this guy! I noticed im his only review also so I wish I would have thought twice about hiring him or fire him after he did not come through the first time! This guy is a complete waste of time and money!
