Stuart R. Berg of Gardern City, NY had me sign a non-refundable retainer agreement to perform work related to my mother's death. Upon further investigation it turns out that non-refundable retainer agreements are impermissible under New York State law. Upon finding this out I contacted Mr. Berg repeatedly for a refund. He ignored my requests for a refund of my retainer and I had to take him to small claims court where he was admonished for making me sign the retainer and I was awarded a refund.
He was hired to handle my divorce, until I switched lawyers because his paperwork was so poorly written and filled with errors. My ex-husband and his lawyer were sorry to see Mr. Berg go because they knew how bad his work was (as stated to my replacement lawyer after the divorce was finalized). He did not respond quickly and I was never in the loop, he made promises which he knew would not be held up in court. I wasted time and money working with this "lawyer". He held my papers hostage until I paid him an unreasonable amount for his faulty work. My new lawyer requested that I fight the charges because his work was so pathetic but I just wanted my divorce and to move on with my life.
