The person that he deposed as the manager of the business wasn't the person I spoke to on the day of my injury. She mentioned the other 2 people who were there on the date of my injury. I looked her up on Facebook and the other 2 people that she mentioned. I saw the man, and the other woman was actually the person who told me she was the manager. I told him she was lying, and was not the manager. He told me the person that he deposed was very professional, well dressed, well spoken, and educated. She may have been all of the above, but she was definitely not the person I spoke to on the date of my injury. The day of the meeting for a settlement, we met at a local restaurant. It was attorney Kluender, his associate, and myself. I once again voiced several concerns again that I had previously sent in emails, and voice messages. emails and voice messages that were never responded to. Attorney Kluender told his associate to write down these points, they were good points, and pertinent to the case. I reminded him that these were all things that I had emailed and voice messaged him. There were several emails that weren't answered, calls never returned. The contractor involved stated someone definitely could have been injured. The bottom line is I received less than 50% of my out of pocket losses. His lack of follow up, and poor execution were a huge disappointment. Before hiring this attorney I only asked the business to cover my medical expenses not covered by my insurance carrier, and lost wages. I was not trying to make money, only be made whole. The ignored my request, so I had to hire an attorney.
