Employee Rights Advocate:For over 14 years, my practice concentration has been in assisting employees in negotiating and navigating all aspects of their employment relation. I have vast experience with drafting, negotiating, reviewing, and modifying employment documents, including without limitation, employment agreements, offer letters, non-compete agreements, severance packages, retention agreements, and ex pat agreements. I have counseled employees on how to handle all employment related concerns, including among others, responding to performance improvement plans, filing an internal complaint, participating in internal and external investigations, corporate whistleblower actions, review and response to code of conduct, employee handbooks, corporate plans and policies. Divorce Mediation and Litigation:Aside from assisting employees in their employment relation, I also assist individuals in making a life transition. Specifically, I am an attorney and mediator and can assist with a mediated divorce, negotiated divorce, contested divorce or uncontested divorce. We recommend mediation in most situations as it allows the parties more flexibility and control over how to resolve their marriage. However, mediation is not the proper course of action for all and in those situations we are prepared to move forward with Court proceedings. I am available to answer questions regarding custody, child support, maintenance, equitable distribution of property, among others.

I was threatened with a legal action by a previous employee. I contacted Ms. Donath and after our initial conversation, immediately retained her to defend my company. I was very impressed by her knowledge of labor laws and the difficulties of navigating the employee/employer litigation landscape. Ms Donath immediately put me at ease and took over the management of the case. Her fees are reasonable. Not once did I feel I was paying for services that were not rendered. Ms Donath is tough, professional and a no nonsense attorney. She was able to resolve our issue, remove the terrible emotional stress it brought about, and bring to conclusion our case. When entering a company, she can, a) work with you to craft a "wish list" of what you are looking for. She knows how to be aggressive, maximize your "ask," with a gift for not "scaring away" the new employer. In option b), the "flip side," when you are responding to a concrete offer, she pores through all paperwork looking for even a specific word that can put your entire "upside" in jeopardy. She makes catches and remedies them: whether they were intentional by the other party, or not, avoiding loopholes and "surprises." She also adds elements that were not included but turn out to be important. She''ll also coach you, if negotiations need to be verbal, on the right approach. When moving on to a new challenge, the same happens...but in reverse. A) Ms. Donath will ensure your separation from your previous position is "locked down" and all proper paperwork, options, stock, and other elements are cleanly covered and addressed. Again, she will make sure that, B) your leaving papers match your entry papers RE terms, and C) every word, again, matches what was agreed upon when you entered. She'll also make sure you are moving to a new challenge for the right reasons, through another one of her chats with you. Finally, she will help maintain your prior relationship despite your moving on. As a bonus, she will always check in during your new employment, and consistently remind you to keep your resume updated "just in case," and to always be pondering if the job is the right fit and checking in on your comfort/happiness in the position so it is not just a "paycheck" but a real passion.
