I have practiced law for 37 years and was a trial attorney from 1989 to 2019. I am now a full-time mediator. My experience in the court system leads me to believe that mediation is often a better alternative than court action. By mediating early in the process, the parties can save a great deal in attorney’s fees, and be spared prolonged anguish and frustration. My goal is to help you resolve your legal disputes in the most cost-effective and satisfying way possible. My philosophy: Chances are your case will settle. Over 90% of them do. Shortly after moving to Santa Barbara I met Sayre Macneil through a non-profit we are both involved in. He was doing some service work for the organization and helped me with the wavers and insurance required to attend an event at the last minute. I thought he had a solid, honest disposition so when I needed some legal work done for an upstart business, I was pleased to retain his council for the project. Sayre was diligent at all stages, and fair in his billing as well. He listened attentively, researched appropriate topics, gave me sound advice and took care of my interests in a prompt, professional manner. I'd recommend his council to anyone established or new to the area.
I was very pleased with how Sayre handle a very difficult situation with my deceased business partner's wife over compensation of business assets. I was under the impression that she had been compensated fairly when we divided up the business assets 6 years previous when her husband had passed away. A situation arose over my stock brokerage account. When I opened this account 6 months prior to my partner's passing, I had put his name on the account not knowing the legal implications that this would create with his passing and him not signing a release. I kept trading on this account and funding this account for 6 years after his passing until I decided to switch brokers. When the broker discovered that my partner was deceased they froze my account. I asked his wife, who was the executor of his estate, to sign a release she balked at it and decided that half of that account was hers. We settled out of court and what could have been a very lengthy and expensive "battle" we came to an agreement about 6 months after I brought in Sayre. He was a very good negotiator in this matter and I could not have settled this without his help.
In 2012 I hired Sayre MacNeil to handle a civil lawsuit against three different parties with many causes of action including breach of contract, fraud, and conspiracy among other allegations. Sayre was very cost effective compared with other attorneys that I interviewed. Sayre was very competent in writing a very complex complaint against the parties and responding to their various motions against us. Sayre displayed a very good understanding of the civil laws involved and the litigation process. We ended up settling in mediation so I cannot comment about his potential performance at trial. My only complaint about Sayre is that he would often wait until just before a deadline to complete a filing or response, but he completed them on time (Note: I am somewhat obsessive about completing any task ahead of me a soon as possible so I am overly sensitive to this issue and in my case I was intimately involved in reviewing each filing.) I highly recommend Sayre MacNeil for any civil litigation that you may have. Of all of the many attorneys that I have interviewed or retained, Sayre is by far the best by any measurement. He also is fluent in Spanish if that matters to you.
