Litigation highlights:Product Liability Litigation: Plaintiff’s attorney for product liability against a multinational corporation with sites in Europe, the Caribbean, and the United States. Court awarded $24,110,348.41.Construction Defect Litigation: Plaintiff’s attorney for several homeowners in California. Jury awarded over $800,000 in 1991, well before the escalation of real estate prices. This sum represented the cost of repair for all of the homes.Securities Litigation: Avoided class action suit for $5 million; successfully settled three shareholder suits against the pharmaceutical company, and successfully settled a stockholder action regarding non-registered securities.Patent Litigation: Plaintiff’s counsel on multi-million dollar patent litigation which is on-going involving several U.S. and foreign patents awarded to personal alarm systems incorporating gps as a locating device in small personal devices such as a cell phone. The patents were awarded by the U.S. government in 1995, before Congress mandated the implementation and incorporation of gps in cell phone in a 1997 mandate. Several Defendants have entered into licensing agreements which as of 2010 total in excess of $7 million. Co-counsel with Girardi-Keese (Los Angeles), Williams Morgan & Amerson (Houston)Contract and Tort Litigation: Successfully litigated numerous actions, including, but not limited to, contracts, unlawful detainer, wrongful foreclosure, and personal injury.Arbitration/Mediation: I have participated in negotiating settlements in dozens of disputes.Regulatory: Successfully settled Customs redelivery actions, participated in rule making process at FDA and FCC, documentation was cited in the final rule issued by the FCC, definitions used by FDA in interpretation of labeling position taken by client.Class Action Litigation: Successfully advocated on behalf of class action claimants in both the Silicone Breast Implant Litigation (arising out of links between silicone implants and certain medical conditions including immune system reactions). Co-counsel with Ropers, Majeski, Kohn & Bentley (San Francisco). Also advocated for class action claimant in the Deep Water Horizon Litigation (arising out of the explosion of the Deepwater Horizon and the resulting massive oil spill in the Gulf of Mexico impacting real property owners and businesses.) Advocated in the In Re Diet Drugs Products Liablility Litigation for the striking of Court Authorized Procedure 16 as the change in filing deadlines constituted a material change in the settlement terms, that the best notice under Fed. R. Civ. Pro. §23 required use of the mails for class members whose address was known (the best practicable notice) not merely website notice, that CAP 16 was designed to fail in actually providing notice to class members and that the Courts broad discretion with regard to notice is not absolute.
