McElvain represented me in an Auto accident. When the settlement was released. He took the agreed upon 1/3rd from the distribution. My medical payments were returned to the adverse insurance company. Before the medical payments were returned he took 1/3rd of that payment!!! Stating to me he had the right to 1/3rd of all total total dollars. Essentially, he was paid by the adverse insurance company for the returned medical payments and that is a conflict of interest. He also took a 1/3rd from the total settlement and a 1/3rd from the returned Med. Payments and that is double dipping.
