I hired Ms. Holman to handle settlement negotiations for a discrimination/retaliation matter against my former employer, who even when shown several different forms of actual evidence to prove my claims, refused to accept responsibility or culpability. Because my former employer is a national firm with many resources, they insisted that I settle my claims with them or take them to court. Knowing that most people don't have the financial resources to out lawyer or out finance them, it was clear that they had mastered the art of strong-arming abused and bullied employees into settling for a token amount in order to get them off the hook. Despite my claim of discrimination and retaliation, or the sheer number of prior employees who suffered the same fate, the unfair and damaging treatment of all employees is of absolutely no concern to this firm, and they refuse to fairly investigate the facts. Therefore, administrators or managers are not held accountable for their actions, and they will stop at nothing in order to cover up their behavior (including false accusations with no supporting documentation or modifying/altering employee records). After a two year battle, I chose to move on and asked Ms. Holman to work with my former employer to finalize the settlement. I gave her a very short window of time to try to negotiate further with a company whose practice was to throw out a very small number, draft an agreement that protects them only, and then announce that there would be no further negotiations. Another words, take it and like it! Ms. Holman was able to familiarize herself with my case overnight, even though it was somewhat complicated, place a call to my former employer and not only convince them to modify the settlement agreement to protect my interests, but increase my settlement amount. What I appreciated about this attorney that completely impressed me and took some of the pain and frustration away, was that she actually listened to me and my view of the facts of the case. She did not interrupt me with can'ts and costs, or tell me why my claims would fail. She did not treat me as the little guy that she was too important to represent, or use her listening filters to cut me off after a few minutes if she felt my case wasn't lucrative enough for her high standards. I have worked in the legal field for 25 years, but am not familiar with employment law, and have never had a case of my own that required attorney representation. The biggest frustration I have had is that most employment lawyers represent the employers, most don't care about anything but the money, and nearly all don't even bother returning your call. There are no employee advocates or resources preventing big companies or firms from subjecting employees to any type of harassment or unfair labor practice they choose, because they know they won't be held accountable. It is a travesty and huge disservice to the workforce throughout the country. In my view, in addition to the desire to make a lot of money, an attorney should have the desire to help the common man who does not have the knowledge or resources to help himself, and looks to that attorney for advice or protection under the law. The only shining light I found throughout this whole ordeal was Ms. Holman, because she had more than a law degree, listened and understood what was important to me. She had enough empathy and compassion to put herself in my place, and a desire to offer whatever help she could. Most importantly, and with all of that in mind, she found a way to make me feel like I lost the battle, but won the war.
