I thought my situation look hopeless when I was arrested. A relative falsely accused me of hitting her. It seemed very bad for me, a big guy arrested for hitting a woman, who had pictures of her face that had blood on it. I looked up online several criminal defense attorneys in St. Mary’s County, and then I read their reviews. Kevin McDevitt hands down received the greatest number of very strong, positive reviews, many more than any other lawyers in the area. I also liked the fact that he had worked as a prosecutor in St. Mary’s County, which meant he was a local lawyer who know how the prosecution lawyers operated. I called Kevin and we set up a time to discuss my case. After listening to me explain what had happened that day, Kevin offered to represent me. We quickly reached agreement on that, after which he told me, “Now I’m your attorney. Once I inform the state, they will have to deal only with me in the future.” Such a relief. I was very glum about my chances, but after I spent another hour or so explaining everything to Kevin, he told me that we had a very good possibility of winning the case. However, Kevin was very realistic. He said sometimes depending cases could turn on the mood of the judge that day. Because of that, he sent me to enroll in an anger management class. "I know you're innocent," Kevin told me. " But if you complete this course before we go to trial, both the judge and the prosecution will look favorably upon it.” One nightmare were the Maryland laws that applied to this my case, assault in the second degree. I was glad to learn that it was a misdemeanor, but then Kevin told me that Maryland was one of the few states that stipulated very harsh sentences for misdemeanors, ten years for second degree assault. The prosecutor did indeed inform Kevin that the state was not only going to for the full ten years. Kevin counseled me that the state was overcharging as a tactic to frighten me, but it was still unnerving. Here I was, never arrested for anything in my life, suddenly facing 15 years in prison. I did make sure I went to all classes in the anger management class. More importantly, I participated in the class, although I was truthful in that I had never let my anger turn into physical violence. At the end, the manager of the class wrote a very nice letter that I had participated fully and made important contributions to the class. Kevin call me practically every week to discuss the case and to give me encouragement. I was very nervous about having that 15 years hanging over me, so that his periodic phone calls to boost my confidence we are very welcome. On the day of the scheduled trial, Kevin came to the courthouse very prepared. He had read everything on the case and watched all of the police video. He showed me his computer and said that he loaded up both the 911 calls and the police video onto it. Kevin said he was very confident that he could win me an acquittal if we went to trial. He was also prepared to closely cross examine the relative who had made the false accusation against me. He had gotten records of her previous arrests that he would use if necessary, plus, he thought he could convince the court that she was lying. He wanted me to sit outside while he went into the courthouse. It turned out that the person who accused me did not show up. the prosecutor and Kevin waited for the accuser to arrive, they talked over the case. Kevin came out periodically to talk to me or called me on the phone to tell me how the prosector was wavering. He finally produced the anger management letter and the state agreed to dismiss the case. Kevin's the one you want if the state comes after you.
