I had Mr. McCarthy as Lawyer for an Industiral accident, it dragged on for over 8 1/2 years. There was repeated harassment by company officials, I repeatedly caught the company doctor in lies. AT&T never paid unused vacation time (I reminded him it was near the deadline and he let it go by without filing for it ( over $6,100). I had 2 witnesses about prior incidents regarding the equipment which led to my injury and he would not check with them. There testimony could have affected what the company would have had to pay out if it was considered negligence, in my favor. He had me pick up an $8.00 rosary for his mother and when I brought it to the office he claimed he had no cash with him and would send me a check---15 years later no check---he claims it was a gift. When the company stated they were about to terminate me unless I went along with company doctors determination I could return to work (he never examined me) [ two surgeons who did thorough examinations found opposite Dr. Waugh's findings] He said he would write a letter to them, the company stated after that I resigned, he agreed. The day that they insisted I return, I was scheduled for presurgical exam and tests, and the company knew it, and deliberately picked that date because of it. At an initial state hearing AT&T was informed they had to pay for upcoming surgery, they refused and I had to. At a later court hearing they were ordered to reimburse me plus 10% annual interest from the day they got the bill until they paid it. They requested and got the reimbursement lowered to workman's compensation rates and waited a few months to pay that after an amount was reached---to date not one cent in interest and he would not bring it up before the judge. I had agreed when the amount was presented to me, figuring the court ordered interest would bring it to about what I had paid, instead I only got about 60% of what I had paid. I know he had other clients from AT&T because he stated how lousy Dr. Waugh was on the stand under questioning, and doesn't mind questioning him beccause he is so lousy. When I was terminated I stated I wanted it to go third party since I now owed the company no loyalty, he claimed we had to go this route first. Before I agreed to the settlement I had told him I wanted him to file a wrongful termination, discrimination against the handicapped suit, he said okay. I had taken this to mean that he would and agreed to sign the settlment papers. I also told him I wanted this to go third party, befor a jury and he said nothing. I had told my father earlier if Kevin McCarthy said no to either I was not going to sign. I figured many things could then come out. HIs okay to the wrongful termination suit and saying nothing to the request to go third party I took to be that he would. Foolish me for trusting him. The settlement did not include for pain and suffering which is standard and normally three times total medical, therapy and related bills, it was just an amount for a permanent 80% loss of function to the leg, which was about 3 years pay. Some lawyers I have talked with later (not on a professional basis) stated with the medical bills and therapy, etc. it should have easily been more than 10 times what I got. Since he was getting paid a third, why didn't he go after this amount? Was I sold out or did he trade me off for easier settlements (faster and less of a fight) for some other clients (some of whom I had foolishly recommended him to). I have since told people who have asked to recommend a lawyer and have given names I wish I knew about then, and I have told them not to go to Kevin McCarthy because he could not be trusted. At the time he was in the law practce of Moren & McCarthy, I have noticed that he now has his own practice. For over a year, after the settlement, I kept calling his office and leaving messages about if he had filed the wrongful termination and discrimination against the handicapped and asked when a hearing might be. The first time he called me back was well over a year later
