Joel I. Fishbein has more than twenty years of experience as a litigator.  He has tried dozens of cases and arbitrations and has extensive appellate experience in the state and federal courts of Pennsylvania and New Jersey.  He has represented numerous plaintiffs in matters that have resulted in settlements or verdicts over one million dollars.   Mr. Fishbein is currently spending much of his time representing nursing homes and assisted nursing facilities in cases involving alleged neglect and abuse.  Because of his expertise in arbitration law and practice, he is helping clients in the drafting of arbitration agreements.  He has also represented businesses and business owners in commercial litigation matters involving executive compensation and covenants not to compete; shareholder litigation on behalf of frozen out shareholders, defamation and tortious interference, and breach of contract cases; and NASD arbitration claims relating to unsuitable investments, churned accounts or fraud.  Recent successes include convincing the intermediate appellate court in New Jersey to enforce an arbitration provision in an assisted living contract which required finding a New Jersey statute prohibiting such agreements to be preempted by the Federal Arbitration Act. Mr. Fishbein was honored by the Philadelphia Business Journal as a "Forty Under 40" (Philadelphians to Watch) in 2000.  He achieved the designation of Pennsylvania Super Lawyer in 2006 and 2010.  He was also awarded the AV Rating by Martindale-Hubbell (www.martindale.com), based on reviews submitted by his peers. This rating is the highest available rating and denotes a Very High to Preeminent legal ability rating and a Very High to Preeminent ethical standards rating. Prior to joining private practice, Mr. Fishbein clerked for the Honorable Frank J. Montemuro of the Superior Court of Pennsylvania.
