During this test, the officer instructs the suspect to follow a bright flashlight with his or her eyes. The guidelines explicitly state where to hold the flashlight and for how long. Using my arrest video and a stopwatch, Jay expertly demonstrated that this officer's nystagmus test did not comply with established procedures. Consequently, the judge did not allow the results of my nystagmus testing to be considered. The nystagmus test was the backbone of the prosecution's entire case. Absent any scientific evidence, the prosecution knew that a conviction was virtually impossible and dropped the charges. The fact that Jay Cohen knew more about nystagmus testing than an actual cop is the only reason in the world that I don't have a criminal record and I will owe him for the rest of my life.
