James Fox advised me regarding a small claims case against a rheumatologist who gave my elderly, frail wife four iron infusions even though blood tests showed there was no iron deficiency. The doctor told me that, since my wife was on hospice, Medicare would not pay for the treatment and that I would have to pay, which I did. I later discovered that he had billed Medicare and been paid by them. The doctor had prescribed 6 infusions, but she died after the fourth. I could not prove that the infusions caused her death or that it was a wrongful death. Medicare documents also showed that the copay for the 4 infusions was about 20% of what I paid the doctor, who refused to refund the difference.
