We even re-confirmed this with him and he stated that he guessed at "around $1,600 but not more than $1,800". Again, we were satisfied with the cost and trusted him. Our itemized bills even included 1 minute phone calls that he either made or received, faxes and letters RECEIVED were also added charges. Maybe this is normal, I don't know, but seemingly tedious. James P. Davis, located in Bellevue, Washington gave my wife and I a verbal guarantee that our specific case would not go over $1,800. We specifically asked him this because we were considering filing bankruptcy on our own if it was going to be too expensive. THIS WAS OUR MAIN ISSUE when we met with him! We met with him for our initial interview (which was not free). We (foolishly) believed what he told us and gave him the retainer fee. We even re-confirmed this with him and he stated that he guessed at "around $1,600 but not more than $1,800". Again, we were satisfied with the cost and trusted him. As the weeks/months went by leading up to our discharge and beyond, the bills continued to come with an average of about $500 per month in new fees. Our itemized bills even included 1 minute phone calls that he either made or received, faxes and letters RECEIVED were also added charges. Maybe this is normal, I don't know, but seemingly tedious. Take this into account if you consider hiring him. He WILL nickel and dime you. Again, maybe this is considered "normal" by some but other lawyers I have used have NOT done this. After we finally paid a total of around $3,800, we said ENOUGH and quit paying him. We already had paid him about $2,000 MORE than the MAX amount he said it would cost and we weren't about to pay any more. I talked with his receptionist about it and she never returned any phone calls after stating that she would discuss this with Mr. Davis. So, I finally wrote a letter to him reminding him about what he promised and my attempts at contacting him. We finally talked on the phone and he said that it "wasn't listed in the contract" and even sent out a copy of it in case I didn't have my own. After paying what we did and after trying to work something out, including even reducing the amount we STILL owed (which was an ADDITIONAL $1,000 OVER the $3,800!), he refused to listen. He sent us a warning letter about it, then he reported it to the credit bureau. It's hard to believe that people do this kind of stuff to others but this guy does and WILL again. My wife and I were still recovering from losing our jobs at the time and had no means to fight against Mr. Davis. Some may say that it's our fault for not having it in writing and I don't completely disagree with that. We should have made sure that was the case. However I still believe that someone who runs a "professional" business should stand by their word. If you aren't a man of your word, what good are you to others that you are apparently trying provide a SERVICE to? Again, we still paid about $2,000 OVER and above the quoted MAXIMUM cost!!! James P.
