About
Heman A. Marshall III is among the most respected attorneys focusing on the ever-changing field of health care law. He provides counsel and guidance to a broad range of hospitals, hospital systems, clinics, physician group practices, individual physicians, long-term care facilities and other health care providers. He also provides advice and counseling to health care and general business clients in all aspects of federal and state antitrust laws and regulations, including their impact on mergers and acquisitions, pricing arrangements, distribution methods, IPA and PHO operations and Trade association activities. His areas of concentration provide clients with a broad perspective not just in health-related industries but in complex areas of federal and state regulatory schemes such as Stark II, state and federal anti-kickback laws, Medicare and Medicaid reimbursement issues, managed care negotiations, physician hospital contracting, Accountable Care organizations, ACOs, HIPAA/HITECH, and mergers and joint venture efforts. In addition, he has guided health care clients in professional licensure actions, professional staff and managed care credentialing issues, certificate of public need questions and all other major areas of health care law.His general corporate and antitrust expertise adds value in areas such as structuring ancillary activities among health care providers, and his antitrust experience enables him to address the antitrust aspects of physician independent practice associations, hospital physician organizations, marketing and distribution aspects of health care systems, issues related to ACOs and other similar cases. He has served as the chairman of the firm’s Health Law Practice group since its inception, and was the initial chairman of the Virginia Bar Association Health Law Section. He also has served as chair of the Virginia State Bar Health Law Section and the Virginia State Bar Antitrust, Franchise and Trade Regulations Section, and is currently a member of the Governing Counsel of the Virginia Bar Association Health Law Section. Heman has lectured extensively to attorneys and health care professionals on numerous topics. His published works include a chapter in the ABA publication The Managed Care Experience and a chapter in the Aspatore series Inside the Minds entitled “Health Care Deal Considerations and Strategies.”He has been listed in Best Lawyers in America under the category of Health Care Law for more than a decade and Antitrust. He has also been listed for a number of years in “Virginia’s Legal Elite”, Virginia’s Super Lawyers and numerous Who’s Who publications including Marquis’ Who’s Who in American Law. He is a Fellow of both the Virginia Bar Foundation and the American Bar Foundation.From 1995-2002, he served as president and/or chairman of the firm.He graduated with high distinction from the University of Virginia and received his law degree from its law school. Heman’s volunteer activities include the Taubman Museum of Art, Bradley Free Clinic, Roanoke Regional Chamber of Commerce and the Advisory Board of the Roanoke Small Business Development Center. He is a recipient of the Virginia Governor’s Award for Volunteering Excellence for his efforts with the Bradley Free Clinic’s major capital campaign.
