I've represented clients in state and federal courts throughout Arizona for more than 3 decades. Having recently completed mediation training at Pepperdine University, I now offer my services as a mediator to assist parties and their counsel in resolving cases outside of the courtroom.  My personal experience evaluating litigation strategies, case values and probable outcomes of cases can be a valuable resource to parties seeking to resolve their legal disputes short of trial. As a trial lawyer and litigator, I've handled prosecution and defense of personal injury claims, including medical malpractice and product liability; insurance law and litigation, including coverage and bad faith claims; contracts and contract litigation; employment law; civil rights; and general civil litigation. I've also practiced administrative law, representing scores of healthcare providers and other licensed professionals before Arizona state licensing boards (including medical, dental, nursing, osteopathic, psychologists, physical therapy, naturopathic, chiropractic, behavioral health and veterinary boards).  I assist licensed professionals in responding to complaints filed with regulatory boards and handling of matters requiring mandatory reporting.  I provide representation in disciplinary investigations and administrative hearings, as well as handling prosecution of appeals from administrative decisions. I'm a graduate of the University of Arizona College of Law (with distinction). My undergraduate degree, a Bachelor of Science (with high distinction) in Animal Health Science, is also from the University of Arizona, College of Agriculture.I firmly believe in the obligation of citizens to give back to their communities, both professionally and personally.  I currently serve as president of the newly formed Pima County Bar Foundation, the charitable arm of the Pima County Bar Association, of which I am a past president (2014-15).  I am on the Steering Committee of the Legal Community Against Hunger and served as both its Chair and Co-Chair from 2004-2014.  I serve on the board of the Diaper Bank of Southern Arizona and from 2006-2012, I was a board member of the Foundation for Creative Broadcasting, which operates KXCI Community Radio (91.3 FM).  As a musician, I often perform for various community fundraising events.For enjoyment outside of legal practice, I enjoy making and listening to music (primarily in the “roots” and “Americana” categories), hiking, backpacking and camping with family and friends, and travel. I've  traveled fairly extensively in Mexico as well as several other Spanish-speaking countries and I'm comfortable with oral and written communication in Spanish.

I consulted with Hardy when I lost my bid for tenure with my university. He helped me navigate the detailed faculty handbook, and explained the meaning of due process violation in the constitution and in practice. I could not have done it without his guidance navigating the intricacies of the law.

He is currently representing me in a case that is very emotional. I know that Hardy truly cares about my well being and is committed to working toward a positive outcome. Of all the attorneys I ever worked with- this individual was one of the most helpful individuals I ever met in my life., I am a physician - I had a problem with an administration playing games that are not uncommon in Tucson. Hardy understood the problem even after my meandering attempt to explain the problem. He was able to see the problem clearly and took the appropriate steps to get the problem administration- to understand their behavior was unprofessional and was inconsistent with their own policies and procedures- and their unrealistic demands to try and get us to work several additional hours without proper compensation represents harassment. Although the same agency is still harassing their current staff- Hardy's help put the agency on notice. It allowed me and several others to escape the poor working conditions they were imposing on their entire staff. Without Hardy's help- the agency would of kept making unfair and unrealistic demands on the staff and myself. Before consulting with Hardy- the agency was ignoring its own policies and procedures - and making unfair demands at their staff. Staff who did not follow these demands were fired and threatened they agency would report this to the employees licensing board. The agency removed important protections for the workers that was written in clear language in their policy and procedures. Hardy made it clear to the agency they were in violation of their own rules. After his notification- several of us were able to successfully get out of our contracts because their demands were in clear violation of policy. When we tried to point this out to the administration before I consulted Hardy- the administration used smoke and mirrors to justify their improper demands. After Hardy made it clear that the agency was violating their own policy with their demands the administration quickly backed away from their demands and most of the staff who were effected - were able to leave the agency. If it was not for Hardy- this would never of happened- and we would of been forced to work in a hostile environment. I recommend Hardy without any reservations- he really saved many of our staff and myself from continued harassment from the agencies medical director and her distorted use of the agencies own guidelines.

Hardy has been a very attentive lawyer to our HOA needs. He has taken on a very complicated smorgasbord of legal issues for the HOA and it's lot owners in a very large planned community here in Arizona. Hardy takes the time to plan his legal moves, so he does not waste your time and money to get you where you want to go, he is very effective counsel for a non profit HOA entities like ours. As for PI litigation, Hardy is very well versed and trained in the art of negotiations, so he can in most cases, effectively get you a settlement without full blown time consuming litigation, however he can litigate if needed, to court and WIN.

Hardy was a kind listening ear in an emotional trying turmoil of a time. I would call crying when another attach came from the neighbor that had decided to come after a portion of my land. He was always a calming, sensible ear for me; and gave me the advice and counsel that got me through it all.

I contacted Mr. Smith when he was recommended to me by another attorney. I had been unable to successfully retrieve monies that were due to me. Mr. Smith was able to get information online and advise me what to do through all the steps of my court documents. He was thorough and very easy to question about my actions. I was able to receive that was due to me and an additional $954 with Mr. Smith's advice. He cares about his clients and he is approachable and very anxious to assist in all matters. I would highly recommend Mr. Smith to other people and I have done just that with a friend who was in a similar situation and Mr. Smith is helping her navigate through her process.
