Thank you for taking the time to visit my profile on Avvo. After obtaining my Juris Doctor from the University of Oregon in 1984 I have practiced law in Northern Nevada for over 30 years and focus on real property law, commercial litigation, and creditor’s rights in bankruptcy. Currently, I serve as counsel to over two hundred fifty homeowners associations throughout Northern Nevada. The associations I represent vary in size from four units to as large as 6,000 and are concentrated in the Northern Nevada area. I provide all aspects of legal services upon request to my associations including interpretation of governing documents and applicable local, state and federal laws; guidance and training to Boards of Directors in connection with running a non-profit common-interest community; developer transition; collection of delinquent assessments; filing and responding to Intervention Affidavits with the Nevada Real Estate Division; all forms of litigation including Alternative Dispute Resolution, complaints in front of the Fair Housing Division of HUD, Small Claims Court, Justice Court, District Court, the Nevada Supreme Court and United States District Court of Nevada; and assistance in collections, liens and foreclosures. I also represent numerous companies in connection with commercial contracts and litigation arising from those contracts. As a result of my representation of associations and parties to contracts, I represent their interests in bankruptcy court. I have also served as a court-appointed trustee for a debtor.

Ms Kern was retained by our HOA to help us stop an Airbnb from doing business in our condo complex. We, as individual owners, do Not feel she represented us as we are still having to find a way to make this condo owner Cease and Desist immediately. She found numerous reasons and ways the Airbnb condo owner Could continue operating But did Not help Us Stop this short term rental. Airbnb is a Business and we are not zoned for a business. And the people who are using Airbnbs are Transients and Not Residents; as our HOA requires in order to to live here. We should not have to rewrite our CC & Rs to limit rental times as it is already illegal for people who are Not Residents to live here Short term or longer if they do not meet our CC &Rs definition off a Resident! Any other rulings regarding Airbnbs Should not Supersede our CC&Rs as they were written 30 plus years ago......long before Airb&bs were even Invented!!!
