In 2016, I had an on the job injury caused by an assault at work. Mr. Mercer kept stating he would take the case to trial and I did all the “leg work” consulting with doctors and obtaining reports on injuries, both mental and physical due to the assault. When it came time for Mr. Mercer to start the workers’ compensation process, he told me he was not going to be doing it, approximately a week or two prior to when the statute of limitations ran out. His reasons were distorted and devious on his part and I had no interest in getting involved with him in anything other than a professional level. I tried calling other law firms, but due to the short time frame, I was unable to have my workers’ compensation suit filed, even after all the doctors appointments he advised me to go to, which I had to pay out of pocket, obtain records and pay for out of pocket and give him records of what happened on my job, to which he has never returned. I still stuffer prolonged headaches, nightmares, fear for safety and harassment due to the work environment I worked in and no one did anything to cover me, the employee. He agreed in the beginning, middle and up until the day I stated I only wanted a professional relationship with him and nothing more to do this case with the standard amount of fees taken out for workers comp cases. I had previously used him for a personal injury case in which he failed to do his own research and actually read the medical records and LOST terribly or even listen. I had injured my back and neck. My back had just previously had surgery, however my neck had never been injured and needed surgery. None of that was even told to the jury or brought out in negotiations.
