1st time I met Ellen McCarthy was in court for a pretrial BWC settlement hearing. After a brief hello she instructed me not to leave the floor and went into conference with the judge and other attorneys. After about 5 minutes she came out and said "as Bob told you, we cannot win this case" The last phone conference I had with Bob about the meeting he stated that we would be disusing, future medical, wage loss, getting injuries that the IC would not allow, and future wage loss. I was shocked by what she had said and before I really had a chance to process what she had said I was told that she could get me something in the way of a settlement to close out this case, witch I did not expect but had concerns and reservations. I am going through the SSDI process and was sent to a Physiatrist who said that my injuries should have been allowed (she is also a BWC doc.) and were definitely work related injuries. I hate to give such low marks but the facts are 1) Trustworthy - I was mislead regarding the pretrial. When I ask Ellen when I could expect the settlement she told me it would be about 30 days. She did not inform me that any of the parties had 30 days to change their mind, after the 30 days if all parties agreed it would be presented to the Attorney General for approval, and the whole process took 66 days which is the normal amount of time. This deception cost me over a thousand dollars for late payment charges for rent. I would have found an alternate way to get the rent money. 2) Responsive in a way she was ok and may have gotten an average but because it was not accurate sorry, 3) Knowledgeable - My experience would be best compared to what one might expect from an attorney's first case involving the BWC. 4) Kept me informed - when the BWC sites that they are supposed to present new information but nothing new is presented by NPHM does not give them much to inform me about
