I am an Arkansas native and love working with Seniors. My family had a business in Northeast Arkansas, so I had a "job" from the time I was born until now. My wife and I have both practiced law for 30+ years and our law firm practices primarily in the area of Elder Law. Specifically in our office, we work with the "kids" (age 50 - 65) who have parents that are in the Nursing Home now or are going to a Nursing Home soon. The goal of these adult kids is usually to help their parent get the best care possible. If facility care is required, we often help the family locate an appropriate facility in thier area of the state AND help them preserve as many assests as possible.Your Mom & Dad may have worked hard their entire life, accumulated a few assets and now want to pass those assets to their children. It is especially important for many Seniors to be able to pass farm property or the family home. We work with families to make this a reality where possible.Unfortunately, many families wait until it is too late. They "spend it all down" for Nursing Home care, to the tune of $6,000 + dollars per month. Then when it's all gone, the Nursing Home helps them qualify for Medicaid assistance. At this point, it's too late! Instead, we work with the family to help protect as many assets as possible. In many cases, it is possible to protect many family assets that otherwise would have been spent down.This is especially important where there is a spouse at home. We have seen situations where the "well" spouse at home spends everything down for the care of their beloved "sick" spouse in the Nursing Home. They usually didn't know that they had an option. They just knew that their spouse needed care and they were willing to spend it all - even if it meant that they would become destitute! It doesn't have to be this way!If the Senior in your life is in a Nursing Home now and is paying for their own care every month "out of pocket" OR if they are headed to a Nursing Home soon, just know that they may have options to preserve some of their hard earned assets by doing advance planning. Don't be like some we have met (after the money was gone) who said, "If only I had known!".
