I was an Assistant District Attorney in the New York County District Attorney's office for four years and then served as an Assistant U.S. Attorney in the Eastern District of California for four and half years. I have been in private practice since 1977 and have tried to verdict serveral hundred jury trials in the state and federal courts of New York and California. I hate to see the negative reviews for Don Heller. Each client is different. If you're guilty, it's tough to "un F*** the Duck". Mr Heller represented me after I had been clobbered by one of the biggest corporations in the world. They were trying to drive me out of business. I was facing a huge problem on a case I had already won. I went to Mr Heller on Christmas Eve and explained the problem. I paid him a major retainer, but he called the opposing law firm in New York City. I couldn't believe he could get anyone on the phone that day, but he did. Thirty minutes later he told me that was the last time they would bother me and that was 10 years ago. He was right, they dropped all their frivolous lawsuits. Mr Heller felt bad about keeping such a large retainer for 30 minutes, so he kept it on file if I had any other problems. A year later my daughter was getting death threats from other high school kids. It got serious and Mr Heller stepped in and made the other kids parents pay for sending my daughter to a privet school for her protection. Mr Heller was the best legal help I ever got. I know he is retiring and the reviews don't mean much now. But I'm sure he still takes pride in his reputation. Have a happy retirement Don, you earned it.
Don represented me in a very winnable case where I was involved in making a citizen's arrest of a hit and run driver who then became assaultive but because of lies told at the scene I was charged with felonies. Don did little to no investigation. He had access to CSI photos which showed me with injuries from the hit and run driver's assault on me but failed to utilize them. My parents were pushing for expert witnesses which Don elected not to use. Don was lazy preparing for trial and underestimated the case. He did not prepare me for my trial testimony whatsoever. Don was so inept that he didnt object to the deputy district attorney inserting a false definition to the jury during jury instructions in their attempt to win the case. I sustained a conviction which ruined my career. If you are looking for an outstanding lawyer in Sacramento I would steer clear of Don and use someone ethical, more humble, and a better trial lawyer like Linda Parisi or someone else. I wish I had.
I thought Mr. Heller would do a great job in my case because he boasted of representing very high profile people. Because Don did not invest proper time in my case I received a conviction I shouldn't have. I think many public defenders would have done a better job. Retaining him was the worst regret of my life.
Don Heller is probably one of the most arrogant people I have ever met (even by lawyer standards). I retained him for a serious felony criminal matter and he botched my case by not putting enough preparation into it. He loves to give interviews and is in the news quite a bit but don't be fooled like I was with his high profile. He will only give your case high priority if you are a "big money" client paying him in the 6 figure range. He loves to represent NBA players. I wish I had never gone to Mr. Heller because I put all of my faith into him because of his reputation and wound up with a needless criminal record.
