Mr. Miller completed his undergraduate education at the University of California in 1968. Upon graduation, he served on active duty in the United States Marine Corps, serving in the Republic of Vietnam in 1969. Mr. Miller spent 27 years in the Marine Corps Reserve, attaining the rank of Lieutenant Colonel. After leaving active duty in the Marines, Mr. Miller attended the University of San Diego School of Law, graduating in 1974. Upon graduating law school, Mr. Miller worked as a criminal defense attorney for several years before starting his own civil litigation practice in 1982.Mr. Miller has over 35 years of experience practicing law, primarily representing plaintiffs in the areas of civil litigation and medical malpractice. He is a board-certified civil trial specialist and has served as a faculty instructor for the National Board of Trial Advocacy, an organization which is accredited by the State Bar of California. In addition, since 2008, he has been awarded a rating of AV Preeminent by Lexis-Nexis® Martindale-Hubbell®, which signifies that Mr. Miller is nationally ranked as possessing the highest possible rating for legal skills and ethical standards. I hired Miller & James to review my case in November of 2016 for $5,000. I work in the courts and see attorneys every day. I could tell David had what it took to win. He was a commander in Viet Nam and you can see it in his style. I was concerned at first because I did not hear from them much. But later I realized it takes time to review all the documents, find a willing expert, etc. (it took about 8 months for my case). Things definitely changed when we began prepping for arbitration. David now called me twice a week. There were times I would call David in tears, and he would pull me through. He was always patient and kind. It said a lot about his character that the letterhead trial attorney would take time for me. When the review was finished, they took my case on contingency. They found an expert who is a highly regarded professor at UC Irvine to testify on my behalf. David and Patricia said I had a good case, but pointed out that all cases can be lost and that there were no guarantees. I told them I didn’t have unlimited funds and they were very sensitive to my financial limitations and worked with me to limit case costs. I was still having some medical issues and David went out of his way to set up an appointment for another opinion. This doctor was the best in his field, and I appreciated David making this happen. His staff was very professional, especially regarding sensitive medical information. I worked with them for over two years on my medical records, discovery, depositions, and arbitration preparations. Medical malpractice cases aren’t for the faint of heart. It was a lot of work. I had to answer long lists of questions and depositions can be a little intimidating. But having good attorneys like David and Patricia by your side makes it better. Later in the case, the defendant made a settlement offer but David advised to reject it. I was glad we did. We went to arbitration and settled for significantly more! Overall, it was a long and difficult experience dealing with my medical condition and a lawsuit at the same time, but David Miller and his law firm were there for me. I really felt like I had a heavyweight champion fighting for me. David didn’t take any crap and fought hard. He’s a good man and I will always be grateful for what he and his staff did for me. David Miller is hands down a conscientious and practical attorney. He approached my case with caution. He read all the details pertaining to my case and did not oversell what the outcome would be! I appreciated how he worked with the apposing council and was respectful to them as they learned their argument was flawed. If a friend needed legal help with something that has happened to them, I would most definitely refer them to David Miller! I was searching for a lawyer and law firm who could be sensitive to what I was going through.I found Attorney David Miller who was not only a true professional with a lot of experience but he had integrity and was very knowledgeable about the law.I was immediately impressed with David and his entire staff they are so gracious and helpful.I really like that I am always updated on my case in a timely manner and it makes me feel secure knowing I have an attorney who is easy to discuss my case with. I found Miller and James via Google. I was frustrated with my dealing with the defendant by myself. I thought that with the expertise of a lawyer that he/she will be able to guide and assist me in getting justice for what happened to me but instead I got in return was a stressful long journey that resulted in settling my case for a very dissatisfactory amount. This company are liars & Crooks, They took $5000 from me to get Expert Doctors for my wife's death and all they got was a Doctor &a Nurse. They refused to name them or the company involved. They ignored my request for an account . After they got the report they wanted $5000 per month reduced to $2000 which I could not afford. I dismissed them in February 2013, 3months after we first met. I asked for my files back which took 3 attempts to get back what they gave me and I am sure they are incomplete. From February 2013 to February 2014 I continued to ask for the report and the names of the people who wrote it. They finally gave me a copy in or about September 2013 but still no accounts. For a whole year I asked for accounts, the names of who did report. Why it was only dictated over the phone ( answer so they never had to disclose it to Kaiser) but they ignored me. In February 2014 just 2 weeks from Summary Dismissal Conference Call I found a Exprt Doctor of my own who stated that they never treated my wife in ER for breathing problems. I went again to see David Miller & Patricia James to get back any files they still had, Names of the Experts and a refund of some of my $5000. While I was there I told them that I had my own Expert Cardiologist and they fell over themselves to take the case on if the Expert confirmed what I told them was true. Mr. Miller told me he would do it on Contingency with no costs to me. I also asked again about the report I paid for and again I got the same answer a Doctor & a Nurse. I said ok because I was desperate with the case starting in 2 weeks. They got an extension to give the Expert more time to evaluate the records. From that day they did nothing to prepare a case or get Discoveries/Disclosures from Kaisers lawyer. When they did Summary Judgement they failed to file documents in time despite being reminded by Kaisers lawyer. The only thing that saved the case was a ER Expert they just decided to use. They asked my Expert too late for him to submit his report at the Summary Judgement. I again started to ask for accounts for the $5000 plus the latest accounts but again these were ignored. I also asked many times for the names of the Doctor & Nurse but and they have ignored/refused me. In November 2014 they dropped the case in a email because I couldn't give them another $5000 at short notice. 45 minutes after sending the email they phoned up for $300 to do a mock trial. When I told the Paralegal about the email she knew nothing about it nor did David Miller. After this I finally got an account after asking again this was marked Pre Bill and it was filled with errors therefore illegal. They refuse to show how they spent the money. I also got told it was a Legal Nurse and not a Doctor & a Nurse but again they refused to name the person. They also changed the initial $5000 from getting Expert Doctors to Flat Fee. They did nothing in regard to the medical records which had redacted tests, pages missing, messages missing ect, which I told them about. Kaisers Lawyers Medical Records are 1000 pages more than mine for same length of time. When they dropped the case they also dropped all costs I owed them but that doesn't make up for leaving the case in a mess or nearly losing my chance for justice in my wife's death. Stay clear of these LIARS & CROOKS if not use at your own risk. I have reported them to the Bar Association and I am looking into Legal Malpractice depending on what the Bar Associations findings are.

I thought that with the expertise of a lawyer that he/she will be able to guide and assist me in getting justice for what happened to me but instead I got in return was a stressful long journey that resulted in settling my case for a very dissatisfactory amount. I was not satisfied with how his firm handled my case specifically after Ms. James took over my case. I thought that they could've helped me better by getting their experts evaluate my condition better to build a stronger case. But instead I had to look for answers myself and find my own doctors. I felt alone in my own battle. I felt pressured and rushed into making decisions that resulted in an outcome I wasn't very satisfied with. I'm left with the medical condition that wasn't resolved and uncertainties that my own healthcare insurance will not go after me should I continue treatment after my settlement. And to date, I have not returned to my doctors to continue care as I'm afraid that my insurance will bill me directly for services pertaining to my condition. I would've probably done better by myself dealing with the defendant if I would've known that his firm would not pursue further than where we got. The settlement that I received with help of his firm didn't even come close to what I've lost. I really wished that I have listened to my friends and family who discouraged me from hiring an attorney. The entire process left me broken - financially, mentally and physically. It was stressful! I wish I could turn back time...the experience I received from his office is unsatisfactory! On the contrary though, Mr. Miller was pleasant and I felt he was sincere when I met with him...thus, resulting in my hiring them to represent me. I wish that no one else would have to go through the stressful process of dealing with a medical malpractice case.
This company are liars & Crooks, They took $5000 from me to get Expert Doctors for my wife's death and all they got was a Doctor &a Nurse. They refused to name them or the company involved. They ignored my request for an account . After they got the report they wanted $5000 per month reduced to $2000 which I could not afford. I dismissed them in February 2013, 3months after we first met. I asked for my files back which took 3 attempts to get back what they gave me and I am sure they are incomplete. From February 2013 to February 2014 I continued to ask for the report and the names of the people who wrote it. They finally gave me a copy in or about September 2013 but still no accounts. For a whole year I asked for accounts, the names of who did report. Why it was only dictated over the phone ( answer so they never had to disclose it to Kaiser) but they ignored me. In February 2014 just 2 weeks from Summary Dismissal Conference Call I found a Exprt Doctor of my own who stated that they never treated my wife in ER for breathing problems. I went again to see David Miller & Patricia James to get back any files they still had, Names of the Experts and a refund of some of my $5000. While I was there I told them that I had my own Expert Cardiologist and they fell over themselves to take the case on if the Expert confirmed what I told them was true. Mr. Miller told me he would do it on Contingency with no costs to me. I also asked again about the report I paid for and again I got the same answer a Doctor & a Nurse. I said ok because I was desperate with the case starting in 2 weeks. They got an extension to give the Expert more time to evaluate the records. From that day they did nothing to prepare a case or get Discoveries/Disclosures from Kaisers lawyer. When they did Summary Judgement they failed to file documents in time despite being reminded by Kaisers lawyer. The only thing that saved the case was a ER Expert they just decided to use. They asked my Expert too late for him to submit his report at the Summary Judgement. I again started to ask for accounts for the $5000 plus the latest accounts but again these were ignored. I also asked many times for the names of the Doctor & Nurse but and they have ignored/refused me. In November 2014 they dropped the case in a email because I couldn't give them another $5000 at short notice. 45 minutes after sending the email they phoned up for $300 to do a mock trial. When I told the Paralegal about the email she knew nothing about it nor did David Miller. After this I finally got an account after asking again this was marked Pre Bill and it was filled with errors therefore illegal. They refuse to show how they spent the money. I also got told it was a Legal Nurse and not a Doctor & a Nurse but again they refused to name the person. They also changed the initial $5000 from getting Expert Doctors to Flat Fee. They did nothing in regard to the medical records which had redacted tests, pages missing, messages missing ect, which I told them about. Kaisers Lawyers Medical Records are 1000 pages more than mine for same length of time. When they dropped the case they also dropped all costs I owed them but that doesn't make up for leaving the case in a mess or nearly losing my chance for justice in my wife's death. Stay clear of these LIARS & CROOKS if not use at your own risk. I have reported them to the Bar Association and I am looking into Legal Malpractice depending on what the Bar Associations findings are.
