It's very hard to find an attorney that understands the unique issues that are part of co-op ownership. You need an attorney that can understand the proprietary lease, which can be very complex. David helped us through a very tough time and I can't thank him enough.
David Gabay has represented me for a couple of years now. He has handled a range of issues from landlord/tenant to family court just to name a few. Mr. Gabay is quick to respond to any question I may have and very knowledgable about the law concerning that subject matter. Dealing with landlord/tenant issues can be very stressful, Mr. Gabay always puts my fears at ease. Through all the difficult situations I have found myself in these past years I have been very happy with the outcome of each case and must say I am glad to have David Gabay working hard on my case and on my side. I would highly recommend David Gabay for all of your legal matters.
He took thousands of dollars and filed my case after the statute of limitations had run out. He kept cancelling depositions saying that I was not available. When in reality I had a personal day approved for every one. He admitted that he did nothing on my case for years. I have it in writing. He allowed the case to drag on for 6 years and then said he "lost interest " in my case and had the court allow him to withdraw. I filed a complaint with the bar, and they found that he did violate their code of conduct and an admonition was placed in his file. I filed a malpractice lawsuit against him. He had a compliance conference adjourned and then sent someone to represent him. Of course I was not there because it was adjourned. He scheduled another compliance conference without notifying me. He appeared and had my case dismissed because I did not appear. I never knew it was scheduled. DON'T HIRE HIM!!
I am writing this review as an actual client: I was recently a client of David Gabay when I payed him to do a simple eviction. I thought initially he was very professional, confident, and really on my side. what i come to experience was quite the opposite. I did not appreciate how he would set a court date for me and at the same time set the same date and time somewhere else but not tell me until the night before that he can't make it. He ended up showing up and calling me last minute again to come down. The judge was not at all happy with how David filed the eviction and because of it he dismissed the case. I never in my life seen a judge scream and embarrass an attorney like the way he did with mine. What bothers me a great deal is that i gave him all the information he needed and he dismissed most of it as not being important/relevant; that turned out to be the very impetus for a simple eviction getting thrown out. as a client of David Gabay I was extremely disappointed in my attorneys performance, I would not use or recommend him again.
