Not sure what to do, and having no money to do anything, I ignored them again until I got a visit from an IRS agent in 2010. She classified me as a “financial hardship” case that was non-collectable and recommended that I file bankruptcy to get a fresh start. I followed this advice, filed my BK, and once it was discharged, watched the liens disappear and enjoyed what I thought was finally a fresh start…but I was wrong. On Aug.23,2013 we hired a taxing firm to handle our tax issues with the IRS in which we owed exactly $100,325 dealing with the IRS on our own was very difficult at its best. Offer in compromise we sough out as the best route to take trying to get our tax debt down. I should have done it years ago, but as this review will explain, I thought I could do it on my own. Since 1999 I have been dealing with IRS issues that were never mine. The problem started in 1999 when my ex-wife unexpectedly moved out of state with our baby, keeping her 1099 income and selling stock she was gifted by her parents in the 80’s, neither of which she ever paid taxes on. At the same time the tech bubble burst, and as I was heavily leveraged, got wiped out. I went from being semi-retired with a baby to being homeless with a non-cooperative spouse almost overnight. Perhaps I was partially at fault by sticking my head in the sand for a few years at the start of the divorce when I was broke and broken-hearted, but my attention was at surviving and getting parenting time, and since I was unemployed, I never filed taxes for years 99-02. In short, my ex-wife’s tax issue somehow became my problem. I received my first letter from the IRS in 2005 stating I owed over $360,000. Over the next few years, this number grew as the IRS filed more liens on me. After many months of back and forth, in 2007 my old accountant was able to get someone from the IRS on the phone, and I heard the message confirming that they would remove the incorrect reporting and remove the liens, however, later that year I received a flurry of tax liens for years 1999-2011 totaling over $780,000. Not sure what to do, and having no money to do anything, I ignored them again until I got a visit from an IRS agent in 2010. She classified me as a “financial hardship” case that was non-collectable and recommended that I file bankruptcy to get a fresh start. I followed this advice, filed my BK, and once it was discharged, watched the liens disappear and enjoyed what I thought was finally a fresh start…but I was wrong. Shortly after the BK, I received new liens from the IRS, citing that the returns that the IRS filed on my behalf were not dischargeable and that I did owe that money with a staggering 22% penalty attached. When I called the agent that had “helped” me before, she recommended that I “move to a state where I didn’t have to wait 7 years to file BK again.” That’s when I broke down and called Dan. He took over. At the time I hired him, my debt was over $400,000. I was surprised when we made our initial offer of $1,014, but I followed Dan’s recommendations and advice. It was a slow and tedious process, and the IRS dragged their feet and was slow to respond throughout. Dan was all over them, and last year they made me a final offer of $21,000. Then Dan took it up with their Appeals Division. and I am pleased to say that a few weeks ago we finally settled for ~$5000, about 1% of what the original problem was.
