Daniel, a founding shareholder of the firm, is an aggressive and creative trial attorney who represents clients in all stages of complex civil litigation in both state and federal courts. In a less adversarial role, Daniel also enjoys helping clients in all estate planning and probate matters.Civil Litigation.Daniel represents clients in sophisticated and complex civil litigation primarily in the areas of employment litigation involving overtime, wage and hour, sex harassment, sex discrimination, age discrimination, race and national origin discrimination, disability discrimination, marital status discrimination, retaliation, whistleblower, and Family Medical Leave Act claims. In addition to securing recoveries for individual employees, he has also made large recoveries for groups of up to several hundred employees in collective class and class action lawsuits in wage and hour cases.Daniel also regularly represents clients in civil litigation involving residential and commercial construction, contracts, and commercial and business law disputes. He is particularly interested in defective construction litigation, as well as mechanic’s liens and payment bonds for his construction law clients. His years of litigation experience in this complex area of law gives Daniel’s clients a competitive edge that have led to favorable settlements, court judgments and jury verdicts, including awards for attorney’s fees, in his clients’ favor. As a civil trial attorney, Daniel has obtained successful and economical outcomes for his clients during all phases of civil litigation in both state and federal courts. He has successfully tried cases to conclusion before both court trials and jury trials. In many instances, however, appeals are necessary. Daniel also has delivered for his clients in the appeals process as a forceful appellate advocate.Estate Planning and Probate.Daniel also enjoys the non‐adversarial environment of estate planning and probate matters. He advises his clients and prepares for them all estate planning documents, including wills, trusts, power of attorney, and health care directives. Daniel helps his estate planning clients attain their goals, whether that is reducing or eliminating an estate tax or avoiding probate, through the smart implementation of credit shelter trusts, revocable living trusts, transfer on death deeds, and other legal tools. He also assists his clients in probate administration of the decedent’s estate, and handles guardianships and conservatorship proceedings. Daniel has a particular interest in helping farm families with estate plans and probate matters, as he was raised on his family’s farm near Crookston, Minnesota. When disputes arise, Daniel is equipped with the necessary trial skills, to represent family members, heirs, beneficiaries, and fiduciaries in claims involving probate and trust administration, as well as issues regarding incapacity, undue influence and breaches of fiduciary duties.Away from the office, Daniel enjoys spending time with his family at their north woods cabin located on Lake Superior, where you may find him sea kayaking on Lake Superior, or relaxing in their Finnish woodburning sauna.
