About

Autumn D. Spaeth concentrates her practice on business and insolvency related litigation.  She specializes in litigation in and related to bankruptcy including fraudulent conveyance, preference, and non-dischargeabilty actions.  She is experienced in receiverships and assignments for the benefit of creditors.  Ms. Spaeth's practice also includes a broad range of business litigation matters in state and federal court including breach of guaranty litigation, partnership disputes, beach of fiduciary duty, unfair business practices, trade secret disputes, as well as intellectual property infringement litigation.  Ms. Spaeth's clients include businesses, their owners, chapter 7 and 11 debtors, chapter 7 and 11 trustees, creditors, assignees for the benefit of creditors, and receivers. Before Smiley Wang-Ekvall, LLP, Ms. Spaeth was an associate in the Trial Department of McDermott, Will & Emery, a multinational law firm, and a partner with Weiland, Golden, Smiley, Wang Ekvall & Strok, LLP, a boutique insolvency firm.Ms. Spaeth received her undergraduate degree in political science from the University of California Los Angeles in 1996, and her law degree from the University of Southern California Law School in 2000, where she was Notes Editor of the Southern California Law Review.  She also received her Master of Arts in Communication Management from the University of Southern California Annenberg School in 2000. Ms. Spaeth currently serves as the Vice Chair of the Ninth Circuit Lawyer Representatives Coordinating Committee and serves on the Ninth Circuit Conference Executive Committee.  She is on the Board of the Central District of California's Attorney Admission Fund.  She was also appointed to the Board of Directors for the Orange County Bar Association.  Ms. Spaeth is the past Co-Chair of the Central District of California Lawyer Representatives to the Ninth Circuit Judicial Conference.  She is a former Chair of the Commercial Law and Bankruptcy Section and the Legislative Resolutions Committee of the Orange County Bar Association.  Ms. Spaeth received an AV peer review rating and was recognized in 2014 as a Southern California Super Lawyer.  She was selected as a Southern California Rising Star by Los Angeles Magazine from 2009 through 2013.  Ms. Spaeth twice has been named one of the Five Top Bankruptcy Attorneys by O.C. Metro Magazine.  She has also been listed as one of the Top Women Attorneys in Southern California by Super Lawyers.  She is a member of the Orange County Bankruptcy Forum, the Federal Bar Association of Orange County, the Association of Business Trial Lawyers, and the International Women's Insolvency and Restructuring ConfederationMs. Spaeth speaks on the topic of litigation in and around bankruptcy and insolvency.  She co-authored, Who is the True Borrower? An Analysis of the Sham Guaranty Defense Reveals a Broad, Fact Intensive, and Total Defense to Deficiency Actions, published by the California Bankruptcy Journal for the 2012 California Bankruptcy Forum.
