I hired Mr. Cramer and his team to handle a 402 reduction and expungement on a 24 year old case. One was to be reduced 2 levels, which I was told was rarely possible. In 2013, my wife and I dropped our son off in St George, UT. to attend the local university. He was 17 and as many college students he was excited to experience life away from parents. Utah, Washington County especially, is not a lenient place to live with strict enforcement of the laws even for even minor infractions. Our son found himself in a very serious situation being charged with a motor vehicle felony. Concerned with Utah’s penalties and sentencing, we could not take this lightly as our son would become a felon and ruin his life forever only after a few months in school. I searched and found Aric Cramer while my son was still in custody. I called Aric Cramer at first light Monday morning and he answered the phone. Aric was very pleasant and understanding. He immediately jumped in with both feet and within a short period, he reviewed the police report, explained the situation and the process to us. I was accused of unlawful sexual activity with a minor in 2014 with the girl who is now my wife. I had spoken with multiple lawyers before pursuing a relationship to make sure it was legal as I was very cautious about it. Three different lawyers and one police officer told me it was ok. A while after initiating our relationship she unexpectedly became pregnant. A friend of my wife's found out and didn't approve of our relationship and reported it to the police. I retained Aric after being convicted of a 2nd degree felony sex offense. I was wrongly accused of this crime and refused a plea deal, even an Alford plea. I did not commit a crime and I refused to even consider a plea deal, that is how much my innocence meant to me, it is a decision that could have cost me a life sentence. My public defender begged me to take a plea and did a less than professional job defending me in my trial. I was charged with a 1st degree felony and the consequences for being found guilty carried a 5 to life sentence, the jury found me guilty of a lesser offense hence the 2nd degree conviction. My PD was never fully invested in my case and was frankly under qualified and ill equipped to mount a proper defense. From the time Aric was retained he was very professional, knowledgeable, and was very proactive in moving forward with my situation, most importantly (to me) was that he believed in my innocence. Aric essentially came into this situation with his hands tied since I had already been found guilty. Aric wrote many motions including an appeal for a new trial, and in an unprecedented maneuver was able to get my felony conviction dropped. This was huge as I was destined to have a felony conviction and a life time on the sex offender registry in my future. I have never heard of anyone being tried, convicted and sentenced having their charges dropped. I wish I would have retained Aric Cramer at the beginning of this ordeal as I am positive we most likely would have never had to plea out or go to trial. About two weeks after my wife and I had returned home from Springdale, Utah on vacation, in July 2013, I got a long distance call from a police Sergeant there. He told me a woman had accused me of felonious sexual assault. I had in fact kissed the housekeeper on the lips. This was immediately before my wife and I left the hotel that morning to return home. We had enjoyed several laughs together with the housekeeper during the preceding week and I saw nothing wrong in what I did. The Sergeant then asked if I had touched the woman’s breasts. I told him I had not. He said she accused me of doing so and that he was going to file a charge of felonious sexual assault against me. This was my first brush with the law. In my 81 years I had had no previous convictions so I had to start from scratch to find two attorneys, one for my home state and the other for Utah. In the latter case an attorney recommended I contact Aric Cramer in St George. About a couple of weeks after the call from the Utah police Sergeant, two members of our local police force knocked on our door and took me into custody, without locking me in handcuffs, I’m glad to say. After waiting two hours downtown, it was then about midday, I was thoroughly searched and finger printed. (It surprised me to discover the full-body metal detector they used was sensitive enough to detect my hearing aids, which I had to remove.) I expected my wife was checking with our local attorney and was very unhappy when I was issued jail clothing making me believe I would stay the night in jail. I was locked in a two-man cell with a young man who had spent some time there on more than one occasion. He predicted they would release me in an hour or two. But time passed and we all left our cells in that area to have dinner. I was concerned that my fellow inmates would be a rough lot but found the opposite and that they were in fact quite friendly and remarked that I should not have been there. We returned to our cells for the night and at about 1AM the door was opened and I was escorted out. About a half hour later I was shown the way to the parking area where my wife was waiting for me in our car. The thought of having to go to prison for 15 years was terrifying after this incident. I went to court in St George, Utah. There my wife and I had our first opportunity, in his offices and the Courthouse, to talk with Aric Cramer. Quite a relief to my wife and me and a well-deserved success for Aric. No prison for me. No conviction for something I didn’t do. (He also had some further evidence that I provided of a remark made by the accuser, but not reported by the accuser.) I was charged with a 1st degree felony and the consequences for being found guilty carried a 5 to life sentence, the jury found me guilty of a lesser offense hence the 2nd degree conviction. My PD was never fully invested in my case and was frankly under qualified and ill equipped to mount a proper defense.
