We had a new employee with less than 90 days service, and after 5 weeks of classroom and OJT training, violate one of our most stringent work rules----twice. The first time we gave her a written warning, the second time it happened we terminated her employment. She filed complaints with both the Federal EEOC and the State ERD claiming discrimination based on her sex, age, harassment, and religion. The State ERD deferred to the EEOC to investigate and they found no merit in her charges. They then dismissed and issued a Right to Sue letter. The claimant filed suit in Federal Court and we engaged our attorney Al Seneczko to help us defend against it. We had a new employee with less than 90 days service, and after 5 weeks of classroom and OJT training, violate one of our most stringent work rules----twice.
